POLICIES
1. Refunds
1.1 All Canadian Driving School 2007 (“School”) does not issue refunds under any circumstance. 2. Cancellations 2.1 Lesson cancellations or changes must be made 48 hours in advance. Failure to do so will result in a forfeit of the scheduled lesson. 2.2 Road test appointments made by the driving school must be cancelled by the student 72 hours in advance in order to avoid ICBC’s $25.00 late cancellation fee. 2.3 A Student who fails to be present at the arranged pick up location at the schedule time or is unable to proceed with the lesson will be a considered a “No Show” and the lesson will be forfeited. 3. Vehicle Usage, Restrictions & Guidelines 3.1 All students must have their driver’s license on their person to proceed with a lesson. If for any reason a student doesn’t have their license, the lesson will be cancelled as per policy 2.3. 3.2 With consideration and approval from an instructor, students taking individual lessons may use an All Canadian Driving School 2007 vehicle for the road test for an additional charge of $120.00 plus tax, which includes a 45 minute practice lesson prior to the road test. 3.3 All Canadian Driving School 2007 Reserves the right to refuse the use of a School vehicle for a road test if an instructor feels the student is not ready for the test. 4. General 4.1 If a student is not enrolled in a package, All Canadian Driving School 2007 charges $60.00 per hour plus tax lessons with a minimum of 55 minutes of practical training time. 4.2 If a student is enrolled in a package, All Canadian Driving School allows 5 minutes per lesson of non practical time to debrief the student or talk with their co-pilot. 4.3 All Canadian Driving School 2007 provides one -on-one training only, the only allowed exception is for the monitoring of our training by ICBC or a school employee to ensure quality. 4.4 All Canadian Driving School 2007 reserves the right to restrict pick up and drop off location at any time. 4.5 All lesson scheduling or changes to the lesson schedule including pick up or drop of locations must be done through All Canadian Driving School 2007’s main office as instructors are not authorized to make or confirm changes. 4.6 Students who are using an All Canadian Driving School 2007 vehicle for their road test but have book the test them self’s must provide the road test confirmation form to All Canadian Driving School. 4.7 Vehicles may be equipped with video and audio devices to ensure quality with the exception of I.C.B.C. road tests. 5. Additional fees 5.1 $25.00 will be charge for any cheques returned by the bank. This charge will be added to any balance owing on your account and must be paid prior to your next lesson. 5.2 Any time An All Canadian Driving School 2007 vehicle goes over a tolled bridge to pick up a student, drop off, for a road test or to conduct a lesson in the preferred area will be charged to the student at $4.00 each way. ALL CANADIAN DRIVING SCHOOL PROVIDES THIS WEBSITE FOR YOU, YOUR EMPLOYEES, AGENTS, AND CONTRACTORS, AND ANY OTHER ENTITY ON WHOSE BEHALF YOU ACCEPT THESE TERMS (COLLECTIVELY "YOU"), SUBJECT TO THESE TERMS. THESE TERMS ARE ENTERED INTO BY AND BETWEEN ALL CANADIAN DRIVING SCHOOL 2007 AND YOU, AND YOU ACCEPT THEM BY: (a) USING THIS WEBSITE IN ANY MANNER; AND/OR (b) ACKNOWLEDGING AGREEMENT WITH THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE. 1.2 This Website ("Website") includes without limitation all possible sub domains and other services accessible via the Website. All Canadian Driving School may control and operate its Website from various locations and makes no representation that this website is appropriate or available for use in all locations. If you are using this website on behalf of Your employer, You represent and warrant that You are authorized to accept these Terms on Your employer's behalf, and that Your employer agrees to indemnify You and All Canadian Driving School 2007 for violations of these terms. 2. YOUR OBLIGATION AND CONDUCT You agree that You will not use the Website to: (a) transmit spam, bulk or unsolicited communications; (b) pretend to be All Canadian Driving School or someone else, or spoof All Canadian Driving School's or someone else's identity; (c) forge headers or otherwise manipulate identifiers (including URLs) in order to disguise the origin of any Content transmitted through the services; (d) misrepresent your affiliation with a person or entity; (e) disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to use the Website; (f) engage in activities that would violate any fiduciary relationship, any applicable local, provincial, national or international law, or any regulations having the force of law, including but not limited to attempting to compromise the security of any networked account or site, operating an illegal gambling operation, stalking, or making threats of harm; or (g) collect or store personal data about other users unless specifically authorized by such users. 3. DELIVERY OF E-MAIL All Canadian Driving will attempt to deliver all of the e-mail that is addressed to Your e-mail address on All Canadian Driving School's services. However, the nature of e-mail is such that All Canadian Driving School cannot guarantee delivery of such e-mail. 4. INDEMNITY You agree to indemnify and hold All Canadian Driving School and its affiliates, agents, licensors, suppliers, other partners, employees and representatives harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of Your use of or connection to the Website (including any use by You on behalf of Your employer), Your violation of the Terms, or Your violation of any rights of another. 5. NOTICES; MODIFICATION AND TERMINATION OF SERVICES; AMENDMENT OF TERMS All Canadian Driving School may provide notice to you via email, regular mail, or posting notices or links to notices on the Website. All Canadian Driving School reserves the right at any time to modify, suspend, or terminate the Services (or any part thereof), and/or Your use of or access to them, with or without notice. All Canadian Driving School may also delete, or bar access to or use of, all related information and files. All Canadian Driving School will not be liable to You or any third-party for any modification, suspension, or termination of the Services, or loss of related information. All Canadian Driving School may amend these Terms at any time by posting the amended terms on this Website. 6. CONTENT PROVIDED VIA LINKS You may find links to other Internet sites or resources on the Website. You acknowledge and agree that All Canadian Driving School is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. All Canadian Driving School will not be responsible or liable, directly or indirectly, for any actual or alleged damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. 7. INTELLECTUAL PROPERTY RIGHTS 7.1 Except as expressly authorized by All Canadian Driving School , You agree not to reproduce, modify, rent, lease, loan, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works of the Content of others, in whole or in part, by any means. 7.2 Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppels, implication, or otherwise. Permission is granted to display, copy, distribute and download Content owned by All Canadian Driving School on this Website provided that: (a) the copyright notice pertaining to the Content remains, and a permission notice (e.g., "Used with permission") is added to such Content; (b) the use of such Content is solely for personal and non-commercial use; (c) such Content will not be copied or posted on any networked computer or published in any medium, except as explicitly permitted by valid permission or license covering such materials; and (d) no modifications are made to such Content. This permission terminates automatically without notice if You breach any of the terms or conditions in this Section 7.2.
